1. Services
Maples Landscaping ("Company," "we," "us") provides landscaping, fire abatement, land clearing, fence building, property maintenance, and firewood delivery services in Mendocino County, Lake County, and surrounding areas of California. All services are subject to availability, seasonal conditions, and property assessment.
2. Estimates & Pricing
All estimates provided are free and non-binding. Final pricing is determined after an on-site property assessment and may vary based on property size, terrain, accessibility, scope of work, and materials required. Written quotes are valid for 30 days from the date of issue unless otherwise stated.
3. Scheduling & Cancellations
Services are scheduled based on mutual agreement. We request at least 24 hours' notice for cancellations or rescheduling. Weather and safety conditions may require us to reschedule at our discretion.
4. Payment
Payment terms are agreed upon before work begins. We accept cash, check, and other payment methods as discussed. For larger projects, a deposit may be required before work commences. Outstanding balances are due upon completion of services unless otherwise arranged.
5. Property Access & Conditions
The client is responsible for ensuring clear access to the work area and for disclosing any known hazards, underground utilities, or property restrictions. We are not liable for damage to unmarked underground utilities, irrigation lines, or other concealed property features.
6. Licensing & Insurance
Maples Landscaping is a local Mendocino County business operating under Business License #137103, with general liability insurance and workers' compensation coverage. We are currently in the process of obtaining a C-27 California Landscaping Contractor's license. Proof of business licensing and insurance is available upon request.
7. Limitation of Liability
Our liability is limited to the value of the services provided. We are not liable for indirect, incidental, or consequential damages. We are not responsible for pre-existing property conditions, natural events (fire, flood, drought), or plant/tree health outcomes beyond our control.
8. Website Use
This website is provided for informational purposes. While we strive to keep content accurate and current, we make no warranties about the completeness or reliability of information on this site. Submitting a form or contacting us through this website does not constitute a binding agreement for services.
9. Governing Law & Venue
These terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws provisions. Any dispute arising out of or relating to these terms or the services shall be brought exclusively in the state or federal courts located in Mendocino County, California, and you consent to the personal jurisdiction and venue of those courts.
10. Disclaimer of Warranties
Except as expressly required by California law, our services and this website are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
11. Severability
If any provision of these terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or, if it cannot be modified, severed from these terms. The remaining provisions will continue in full force and effect.
12. Entire Agreement
These terms, together with any signed estimate, work order, or written agreement between you and Maples Landscaping for the services described therein, constitute the entire agreement between you and Maples Landscaping regarding the subject matter and supersede all prior or contemporaneous communications, proposals, and representations, whether oral or written.
13. Changes to Terms
We reserve the right to update these terms at any time. Changes are effective upon posting to this page. Continued use of our services or website constitutes acceptance of the updated terms.
